Tenancy Law

Tenancy law regulates aspects of property management for private owners, real estate companies and tenants. In particular, tenancy law regulates the rights and obligations of tenants and landlords. These include, among other things, rent and termination protection procedures and claims arising from tenancy agreements.

Tenancy law is comparatively complex, as it is not always easy for laypersons to distinguish between the individual terms and circumstances. Among other things, it is necessary to compare the terms "property" and "real estate", even though they are often used synonymously in everyday language. According to Art. 3 para. 2 of the Land Register Ordinance, a property is "any area of land with sufficiently defined boundaries". These can be traced on the basis of the land register and must be marked on the land. Under certain circumstances, rights of use can also be traded as real property.

In connection with the purchase of real estate or property with subsequent renting, uncertainties or unanswered questions can quickly arise.
