Public Procurement

Public procurement is regulated by the WTO Agreement on Government Procurement of 1994 as well as the Federal Law on Public Procurement, the Intercantonal Agreement on Public Procurement and the cantonal laws and submission ordinances.

The regulation of public procurement is complex, which often leads to uncertainty. Our lawyers help clients navigate this complex legal environment. We advise private actors and public institutions on the structuring and implementation of tenders. Among other things, we draft and negotiate procurement contracts for you and advise you on legal requirements and regulations. We provide expert assistance throughout the entire process and support you in developing optimal solutions.

Furthermore, public procurement is partly exposed to the risk of corruption. Compliance and measures to prevent corruption and money laundering are core competences of our law firm. In particular, our owner, attorney-at-law Dr. Dr. Fabian Teichmann, LL.M., completed his doctorate on the topics of circumvention possibilities of money laundering prevention measures and anti-bribery compliance incentives at the Universities of Kassel (Germany) and Zurich (Switzerland).

Based on our long tradition and in-depth expertise in the field, we advise companies on the development of suitable internal compliance programs as well as their implementation. Together with them, we develop the optimal strategy for your individual needs and implement appropriate measures to prevent compliance violations. We also advise local governments and authorities on these and other topics related to public procurement and legal issues.

Furthermore, we represent our clients before all Swiss authorities and courts as well as before international arbitration tribunals. You benefit from our many years of experience in litigation, which enables us to achieve the best possible results for our clients in a precise and targeted manner. Economic aspects also come into play here, as these play an important role in connection with public procurement. Due to our interdisciplinary orientation, we always succeed in integrating important economic aspects into our strategy.
