Education Law

Education law covers all areas and institutions of education and thus regulates an important human right. In Switzerland, the education system is mainly the responsibility of the cantons and municipalities. Through the adoption of the Education Constitution, the Confederation and the cantons were obliged to ensure, jointly and within the scope of their competence, high quality, and permeability of the Swiss education area.

Schools, universities, and other educational institutions play an important role in everyone's life. In this context, many areas of administrative and constitutional law overlap in these educational institutions. Particularly noteworthy at this point are procedural regulations, personnel law, private law, and school law. Custody rights of separated parents and the resulting problems in communication between schools and parents come into play. Aspects of child protection and data protection also play a role in matters of education and school law.

School law mainly regulates the rights and duties of school authorities, school supervision, parents, pupils and teachers. As a branch of special administrative law, it is part of public law.

Legal problems in the field of education law can be related, for example, to a lack of available kindergarten places, unfair grading or excessively long working hours in training companies. For clients, these represent a significant impairment, because they partly decide on their own future or the future of their own children. A lawyer for education law can help you to enforce your claims - among other things, also by filing a lawsuit for a place at university or challenging an examination result.
