Contract Law

Contract law regulates the conclusion of contracts as well as the legal effects and execution of contracts and breaches of contract. The contracting parties are always natural or legal persons. The majority of contract law provisions are found in the Code of Obligations (OR), which consists of a general and a special part.

Contract law focuses on freedom of contract, which includes freedom of content and form, freedom of conclusion, freedom of form, freedom of choice of partner and freedom of cancellation or amendment. The parties are free to choose whether to use the various contract types of the CO. Provisions on consumer and personal protection as well as formal requirements, on the other hand, restrict the freedom of contract.
