Competition Law

Competition law includes antitrust law and the law against unfair competition. It is based on the view that competition must not be left to its own devices. The aim is to protect market participants and consumers. Antitrust law has the task of protecting the existence of competition, while fair competition law requires market participants to use fair means.

Antitrust law ensures a diversity of suppliers. Consumers of products and services in markets with a high number of suppliers benefit from higher product quality and better prices due to the higher competition. If, on the other hand, a supplier has a monopoly position in a market, or if individual market participants collude with each other and form a cartel, consumers have no choice regarding the use of products and services. This means that the companies involved can offer products and services at high prices and lower quality. This must be avoided. Companies involved in a cartel or an economic agreement can benefit from the leniency program by making a voluntary declaration at an early stage and before the other companies involved.

Examples of unfair competition practices are imitation of products or services, aggressive sales methods, inducing breach of contract, comparative advertising, misleading advertising, exploitation of others' performance results and more. Antitrust law is mainly enforced through administrative channels. In contrast, unfair competition law is mostly enforced through private law.
